- 110K civil cases are registered in the Court of Session and Sheriff Courts every year
- A small number of these cases actually proceed to proof and have a court hearing. This indicates that many of these cases could be dealt with outside of court
- Current court system is too costly, too slow and too complex for the users of the service
- The driver is to prevent cases going to court and relieve the burden and pressure on courts
- The Scottish Civil Justice Council Annual Programme 2015/16 has stipulated a review of the use of Alternative Dispute Resolution methods in appropriate cases in Sheriff Court and the Court of Session
- It’s aim is to broaden the access to justice and resolve disputes easily and quickly with a more affordable and user-friendly service
- Information and advice needs to be clear and consistent across all channels (Level 0)
